Eligibility and Account Registration

Eligibility:

You must be at least 18 years old and have full legal capacity to enter into contracts in order to use the Platform. By registering an account, you represent that you are 18 or older and that the information you provide is truthful and accurate. If you are registering on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.

Account Registration:

To access certain features of the Platform (such as creating listings, making bookings, purchasing packages), you must create an account. You agree to provide complete, accurate, and current information and to keep it updated. You are responsible for all activities under your account. We reserve the right to refuse, suspend, or terminate accounts that violate these Terms or provide false information.

Identity Verification:

We may require identity or eligibility verification to ensure trust and safety. This may include email/phone verification, government-issued identification, selfie verification, or use of third-party identity services (KYC checks). Your personal data will be handled in accordance with our Privacy Policy.

Platform Use and Nature of Service

All property rentals and sales must be arranged through the Platform. Circumventing the Platform for bookings, sales, or payments is prohibited.

Payments, Fees, Service Packages, and Escrow

All payments for listings, packages, or promotional features are processed via secure third-party payment processors (e.g., Stripe) and may be made by credit card, debit card, Apple Pay, premium SMS, or other supported methods. Once a listing or package is paid for and published/activated, it is non-refundable regardless of subsequent changes, removal, or early expiry, except as required by mandatory law.

Livappy may introduce, update, or discontinue service fees, packages, and escrow options at any time. All changes are reflected in the official price list and will be notified to users as appropriate.

Livappy reserves the right to request proof of ownership or right to list, and to remove or modify listings that violate these Terms or the law. Users are responsible for monitoring expiry dates of their listings or packages.

Listing Duration:

Each standard listing is published for a defined period (e.g., 30 days for sale or rental listings), after which it may expire or require renewal. Package holders must use their included listings within the package validity period. Unused listings expire at the end of the package and are not refundable.

Promotional Features:

Users may purchase upgrades (e.g., top placement, featured listings) for additional fees as per the price list. Promotional features may be discounted for package holders as set out in package terms. These fees are non-refundable once the promotion is applied.

Refund Policy

All listing fees, package fees, promotional feature fees, escrow fees, and lead fees are non-refundable once the relevant service has commenced or the listing is published, except as required by applicable law. Users expressly acknowledge and accept that by submitting payment and commencing use of the service, they waive any statutory right of withdrawal for digital content or services delivered in full prior to withdrawal.

User Obligations and Prohibited Activities

Verified Users:

Clients who complete Livappy's identity verification process (including but not limited to ID verification, selfie verification, or third-party verification services) will receive a 'Verified' badge on their profile and listings. Verified users may enjoy higher visibility and perceived credibility compared to non-verified users.

The Verified badge indicates only that the identity has been checked, not the financial standing, solvency, or suitability of the user.

Violations may result in suspension, removal of content, account termination, legal action, or reporting to authorities.

Intellectual Property

All Platform content (excluding user-submitted listings and reviews) is owned by Livappy OÜ or its licensors and is protected by copyright, trademark, and related laws. No user may copy, reproduce, or exploit Platform content without written permission.

By posting content, users grant Livappy a license to use such content for operating and promoting the Platform.

Limitation of Liability

Livappy acts solely as an intermediary and is not a party to rental, sale, or agency contracts between users. Users are responsible for their listings, conduct, and compliance with law.

Livappy is not liable for the accuracy of user content, success of transactions, or the conduct of other users. The Platform and all services are provided "as is" and "as available".

To the extent permitted by law, Livappy's total liability is limited to the greater of €100 or the total service fees paid by the user in the preceding 12 months.

Nothing in these Terms excludes liability that cannot be excluded under law.

Dispute Resolution and Complaints

Users may report illegal, fraudulent, or abusive conduct via the Platform's report tool or at info@livappy.com. Livappy will act promptly in accordance with the EU Digital Services Act.

Users may seek out-of-court resolution through the EU ODR platform: https://ec.europa.eu/consumers/odr

Estonian law applies unless mandatory law of the user's residence country provides otherwise.

Changes to Terms

Livappy may update these Terms and the price list at any time. Notice of significant changes will be provided via the Platform or email. Continued use of the Platform constitutes acceptance of the new Terms.

Final Provisions

These Terms (with Privacy Policy and Cookie Policy) are the entire agreement between the user and Livappy OÜ. Severability, assignment, and other legal clauses apply as previously described.

The English version prevails in case of discrepancies.
